Terms and Conditions

These Terms govern access to and use of the private Photography Archive of James Mendell (the “Archive”). By requesting access, accepting an invitation, creating an account, or using the Archive, you agree to these Terms.

1. Private, limited access

Archive access is personal, limited, revocable, and assigned by role. You may not share an account, password, invitation link, download, or other access credential. Approval to browse the Archive does not itself authorize reproduction, publication, exhibition, distribution, licensing, commercial use, or any other use of a photograph.

2. Copyright and collection ownership

Unless otherwise identified, photographs and collection materials in the Archive are part of the James Mendell collection and are copyrighted by James Mendell and/or members of the Mendell family, as applicable. All rights are reserved. A person’s appearance in a photograph does not give that person ownership of the photograph or permission to copy, download, distribute, alter, publish, license, or authorize its use.

3. No implied license

No license or transfer of copyright is granted except through express written permission identifying the photograph, recipient, approved use, and any applicable conditions. A download made available through the Archive is authorized only for the approved request, project, format, audience, and purpose. Additional or different use requires new written approval.

4. Rights of depicted people and third parties

Permission from the Archive concerns only rights controlled by James Mendell or the applicable Mendell family rights holder. It does not represent that every proposed use is cleared for privacy, publicity, personality, trademark, property, contractual, moral, or other third-party rights. Users are responsible for determining and obtaining any additional releases, permissions, and legal clearances required for their intended use.

5. Prohibited activity

You may not circumvent access controls; remove or obscure a watermark, credit, copyright notice, filename, or metadata; scrape or systematically extract content; use automated collection tools; create or train facial-recognition, biometric, machine-learning, or generative-AI systems using Archive material; reverse engineer download controls; or reproduce, publish, sell, sublicense, distribute, publicly display, or commercially exploit Archive material without express written permission.

6. Sensitive and archival material

The Archive contains historical photographs of people, families, private settings, and events. You agree to handle all material respectfully and confidentially, to consider the dignity and reasonable privacy interests of depicted people, and to notify the Archive of sensitive material or a credible concern. Access may be restricted while a concern is reviewed.

7. Metadata and historical accuracy

Dates, names, locations, keywords, captions, identifications, and other archival information may be incomplete, provisional, or inaccurate. The Archive does not guarantee metadata accuracy. Corrections and supporting information are welcome.

8. Security and enforcement

Access and download activity may be recorded for security, rights management, and auditing. We may suspend or terminate access, revoke an invitation or download authorization, investigate suspected misuse, and pursue available remedies when these Terms or an approved-use condition is violated.

9. Availability and disclaimers

The Archive is provided on an “as available” basis. Access, features, metadata, and content may change or be withdrawn. To the extent permitted by law, the Archive and its rights holders disclaim warranties not expressly stated in writing.

10. Changes and contact

Material changes will be issued as a new version and may require renewed acceptance before continued access. Questions, permissions, corrections, and concerns may be sent to esther@verbsconsulting.com.
